1. Our Services

Growth Planet is an online learning platform that provides users access to high-quality educational content including pre-recorded video courses, downloadable resources (PDFs, templates, and related materials), assessments, and certificates of completion. All content is currently produced and curated in-house by our team of educators and subject-matter experts.

Our Services are intended for personal, non-commercial educational use only. The information and content provided through the Services are not intended for distribution to or use by any person or entity in any jurisdiction where such use would be contrary to applicable law or regulation.

We reserve the right to update, expand, or modify our course offerings, features, and content at any time without prior notice.

2. Eligibility & Age Requirements

To use Growth Planet, you must:

⦁ If you are between 13 and 17 years of age (a minor), you must have the express permission of a parent or legal guardian, who must read and agree to these Terms on your behalf before you use the Services.

4. Intellectual Property Rights

Our Content

Growth Planet owns or holds valid licenses to all intellectual property in the Services, including but not limited to: video courses, lecture materials, assessments, downloadable resources, software, website design, audio, graphics, photographs, text, logos, and trademarks (collectively, "Content" and "Marks"). All Content is protected under applicable Indian and international copyright, trademark, and other intellectual property laws.

License to Users

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

⦁ Download permitted materials (such as PDFs and templates) that are explicitly marked as downloadable, solely for personal use.

This license does not permit you to: share your account credentials, redistribute course materials, upload course content to any other platform, resell or sublicense any Content, or use Content for commercial or revenue-generating purposes without our prior written consent.

Your Submissions

By submitting any feedback, suggestions, ideas, or other communications to us, you grant Growth Planet a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and distribute such submissions for any lawful business purpose, without compensation to you.

5. Course Access, Licenses & Certificates

Upon purchasing a course on Growth Planet, you receive a personal, non-transferable license to access that course for your own educational purposes. Specifically:

⦁ Lifetime access to purchased course content is granted to the purchasing account and may not be transferred.

⦁ Course access is tied to the account used for purchase. Sharing access with others is prohibited.

⦁ Downloadable materials included with a course are for personal use only and may not be distributed, resold, or reproduced.

⦁ Growth Planet reserves the right to update, modify, or retire course content to ensure quality and accuracy. We will make reasonable efforts to notify users of significant changes.

We may, in the future, make content from third-party instructors available. Any such future content will be subject to additional terms communicated at that time.

6. Purchases & Payment

Growth Planet offers courses on a one-time purchase basis. By completing a purchase, you agree to the following:

⦁ All payments are processed in Indian Rupees (INR).

⦁ You agree to provide accurate, complete, and current payment and billing information.

⦁ You authorize us to charge your chosen payment method for the full purchase amount at the time of order.

⦁ Applicable taxes (including GST) will be added to the purchase price as required by law.

⦁ We reserve the right to update pricing at any time. Price changes will be communicated before taking effect.

⦁ We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear fraudulent or suspicious.

⦁ A clear explanation of the reason for your refund request.

Refund Considerations

When reviewing refund requests, we may consider the following factors:

⦁ The proportion of course content accessed or completed.

⦁ Whether a technical issue prevented proper access.

⦁ The nature and validity of the concern raised.

⦁ Time elapsed since the original purchase.

Growth Planet reserves the right to decline refund requests where significant course content has already been consumed, or where we reasonably determine that the request is not made in good faith. Our decision on refund eligibility is final.

8. User Representations

By using the Services, you represent and warrant that:

⦁ You will maintain the accuracy of your account information and promptly update it as necessary.

11. Reviews & Ratings

Growth Planet may provide areas on the platform where users can post course reviews and ratings. By posting a review, you agree to:

⦁ Only review courses you have personally accessed and experienced.

⦁ Provide honest, fair, and constructive feedback.

⦁ Refrain from using offensive, abusive, racist, discriminatory, or sexually explicit language.

⦁ Not post reviews that reference illegal activity or make false or misleading statements.

⦁ Not organize coordinated campaigns to artificially inflate or deflate ratings.

Growth Planet reserves the right to remove, reject, or moderate any review at its sole discretion. By submitting a review, you grant us a perpetual, royalty-free, worldwide license to display, reproduce, and use that review in connection with our Services.

12. Privacy Policy

We take data privacy seriously. By using our Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms by reference and available on our website.

13. Certificates of Completion

Growth Planet issues digital Certificates of Completion to users who successfully complete a course. Please note the following:

⦁ Certificates are issued to the registered account holder upon completion of all required course modules.

⦁ Certificates are for personal and professional development purposes and are not a substitute for accredited academic qualifications.

⦁ Growth Planet does not guarantee that certificates will be recognized by any employer, academic institution, licensing body, or government authority.

⦁ Certificates are tied to the completing account and may not be transferred or reissued to another person.

⦁ We reserve the right to revoke a certificate if it is found to have been obtained through dishonest means, including academic dishonesty or account sharing.

Growth Planet reserves the right to modify the design, format, or issuance process for certificates at any time.

14. Services Management

Growth Planet reserves the right, at its sole discretion, to:

⦁ Monitor the platform for violations of these Terms and applicable laws.

⦁ Take appropriate legal action against users who violate these Terms, including reporting them to law enforcement authorities.

⦁ Restrict, suspend, or terminate access to all or part of the Services for any user, without notice or liability.

⦁ Remove or disable content that is excessive in size, technically burdensome, or in violation of these Terms.

⦁ Make changes to the platform's features, interface, and content offerings at any time.

15. Term & Termination

These Terms remain in full force and effect for as long as you use the Services. We reserve the right to deny access, suspend, or permanently terminate your account at any time, without notice, for any reason, including but not limited to:

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. You irrevocably consent to the exclusive jurisdiction of the competent courts of India to resolve any dispute arising from or in connection with these Terms.

18. Dispute Resolution

Informal Negotiations

Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith informal negotiations for a period of at least 30 days, commencing from the date of written notice by either party.

Binding Arbitration

If informal negotiations fail to resolve the dispute, it shall be referred to and finally resolved by binding arbitration under the Indian Arbitration and Conciliation Act, 1996, as amended. The seat of arbitration shall be India, and proceedings shall be conducted in the English language.

Restrictions

All disputes must be brought individually. No class-action arbitration, class-wide proceedings, or representative claims on behalf of others are permitted under these Terms.

Exceptions

Either party may seek emergency injunctive relief or enforcement of intellectual property rights directly through a court of competent jurisdiction without first engaging in informal negotiations or arbitration.

19. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GROWTH PLANET DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF CONTENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, VIRUS-FREE, OR THAT COURSE CONTENT WILL MEET YOUR SPECIFIC EDUCATIONAL OR PROFESSIONAL REQUIREMENTS. YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK.

20. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GROWTH PLANET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SPECIFIC COURSE OR SERVICE FROM WHICH THE CLAIM ARISES. CERTAIN JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

21. Indemnification

You agree to defend, indemnify, and hold harmless Growth Planet and its affiliates, officers, agents, partners, and employees from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from:

⦁ Your use of or access to the Services.

⦁ Any breach of these Terms by you.

⦁ Your violation of any applicable law or the rights of any third party.

⦁ Any content or submissions you provide to Growth Planet.

We reserve the right to assume exclusive control of any matter subject to indemnification at your expense. You agree to cooperate with our defense of such claims.

22. User Data

You also agree to the use of electronic signatures and records for any transactions or agreements initiated through the platform, and waive any rights requiring a physical signature under applicable law.

24. SMS Text Messaging

By opting into Growth Planet's SMS communications, you consent to receive text messages (SMS) related to your account, course updates, and promotional offers.

Opting Out

Reply STOP to any SMS message to unsubscribe at any time. You will receive a confirmation of your opt-out. To re-subscribe, sign up again through the platform.

Message & Data Rates

Standard message and data rates may apply, depending on your mobile carrier and plan. Carriers are not liable for delayed or undelivered messages.

25. Miscellaneous

These Terms, together with our Privacy Policy and any other policies posted on the Services, constitute the entire agreement between you and Growth Planet with respect to the Services.

⦁ Waiver: Our failure to enforce any right or provision under these Terms does not constitute a waiver of that right.

⦁ Severability: If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will remain in full force.

⦁ Assignment: We may assign our rights and obligations under these Terms at any time. You may not assign your rights without our prior written consent.

⦁ No Partnership: Nothing in these Terms creates a joint venture, partnership, agency, or employment relationship between you and Growth Planet.

⦁ Force Majeure: Growth Planet shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, government actions, or internet outages.

⦁ Language: These Terms are drafted in the English language, which shall govern in the event of any conflict with a translated version.
